Before You Vote, Think! NDTF appeals

The NDTF requests you to vote and elect Dr. MANOJ KHANNA (BALLOT NUMBER 2) to DUTA PRESIDENTSHIP. Dr. Manoj Khanna, a young and dynamic teacher leader has both the enthusiasm and idealism of the youth and the required experience of teacher representation in academic council and DUTA executive. He has assured us all that, if elected to president ship, he will run DUTA through consensus, articulating and pursuing the interest of all sections of the teaching community. The charter of demands unanimously adopted by the general body of DUTA will be seriously pursued. His emphasis will be on results and not on mere rhetoric. Equal attention will be paid to improve the teaching / learning/ research processes through providing required infrastructure.

Young teachers: New entrants to permanent positions, temporary and ad hoc teachers constitute the future both of university system and of the DUTA. It is imperative that DUTA leadership should be more sensitive about the future. During the next few months as ordinances and regulations on appointments and promotion processes have to be finalized. MANOJ KHANNA as president will ensure that DUTAⳠefforts are result oriented (to the advantage of teachers) and not merely rhetorical. The challenges posed by the API/PBAS system have to be resolved through logical and practical steps.
The AAD leadership of DUTA is trying to hoodwink teachers through SMSes, mails, and spreading rumors and propaganda of ahievement such as advanced increments to ad-hoc teachers without any proper notification by the UGC/ University Executive Council resolution. PLEASE DO NOT FALL PREY TO THIS! It is important to note that the university executive council passed a similar resolution 1991 which was later withdrawn. The university has rejected cases of teachers eligible for promotion before 30th June, 2010 for readership, (eg. Rajiv Aggarwal, Department of Mathematics, Sri Aurobindo College), contrary to the ahievementclaim of AAD.
There is a point to ponder, the VC and his team is colluding with the incumbent DUTA leadership. If this leadership is re-elected how will it fight the university establishment? It cannot fight the political executive in any case. Also, history has established that DTF- Left leadership believes only in politics of appointments in university departments and colleges. Most of the time against the collective interest of the teachers they have compromised with the teacherⳠcause. Their stance on semester issue in the Delhi High Court and the Supreme Court in collaboration with JAB brought an utter failure to the DUTA despite a cohesive struggle.

Child Care Leave for Delhi University Teachers

A brief letter has been issued by Deputy Registrar regarding Child Care Leave (No. CCL/2011/CS-III/2227/ dated August 19, 2011). It says that college may appoint Guest Teacher/ad-hoc teacher against teachers availing child care leave. This was definitely one of the major concerns.

There are many issues which have not been clarified in that:
1. How do you decide who will get when?
2. what about those who were granted child care leave earlier?
3. How long it may be available?
4. In women colleges, there may be many applications. So how do you grant these?

The undersigned is directed to refer to this Department's O.M. of even number dated 11th September, 2008 regarding introduction of child care leave in respect of Central
Government employees and subsequent clarifications vide O.M. dated 29th September, 2008 and 18th November, 2008. It is further clarified that child care leave sanctioned prior to issuance of O.M. No. 13018/2/2008-Estt.(L) dated 18th November, 2008 shall be treated as child care leave and shall be deducted from the Child Care Leave account of the Government servant concerned. No adjustment against any
other kind of leave shall be made in this regard. The Child Care Leave sanctioned for the period beyond 18/11/2008 shall however be regulated in terms of clarification issued vide O.M. of even number dated 18/11/2008.

Manoj Khanna appraoches Teachers with New Agenda

Dear friends,
I approach you for your vote and support with the solemn assurance that I, if elected to the DUTA president-ship, will surely work to build up a strong and united teacher movement by taking into confidence all the sections and factors. I reiterate my firm belief that even though we may be contesting elections from different groups, the DUTA is one and singular. No “presidential” faction alone can successfully run the DUTA to yield the desired results. The DUTA has to effectively articulate and pursue the issues relating to all sections of the teaching community. Also, as a responsible body of academics, the DUTA has to be an effective instrument for improving the teaching learning process, promoting research facilities, providing the required academic infrastructure to cope up with the OBC expansion, etc.
Even though the DUTA has to multitask to pursue all the diverse issues, the focal activity has to be to effectively engage with the legitimate concerns of the younger teachers. Hundreds of young teachers have not yet been promoted even though eligible. There are over 2000 ad-hoc teachers facing uncertain future. There are rumors of two years ban on permanent appointment. The illogical anomalies in fixation of points have not yet been addressed even though the pay scales are implemented w.e.f, 2006.
Similarly senior teachers are also facing frustration. GPF is being denied to senior teachers even thought they are eligible for pension scheme in accordance with the May 1987 GOI notification. Contribution to WUS has been retrospectively increased to 500 per month and deductions from salaries made. Retiring teachers have to shell out whooping Rs. 60,000 in order to avail of the medical scheme after superannuation.

Friends, in our earlier newsletter (NDTF) we had raised some major issues. Through this letter I would like to re-emphasize some of the priority issues. I would however hasten to add that DUTA has to pursue all the issues decided by the GB.

1. Pay scales and service conditions:
v Every pay commission has two components: pay scales and service conditions (promotion schemes, placements and other benefits). Though pay scales were implemented in 2008, their anomalies have not been removed till date. Fixation of salaries, in many cases, needs to be relooked into. In PB 3 minimum fixation of salaries for grade pays 6000, 7000, 8000 need to be worked out. There is no clarity about the date of implementation for the in-service PhD increments. In many cases wrong recoveries have been made from teachers. Child Care Leave (CCL) has been denied to many teachers and the university ordinances, as yet, do not provide for a full time replacement against the CCL. This needs special attention as many of our lady colleagues are facing hardship due to the dilly-dallying by the university administration.
v Those teachers who have completed three years in the grade pay of 8000 be given PB-4 without any delay.
v It is unfortunate that an unnecessary divide is being created among the teachers those who are eligible for promotion before and after 30th June 2010 especially when no ordinance relating to the new promotion scheme is in place.
v The point system under the API/PBAS is geared to deny promotions rather than to grant it. The focal fight has to be to replace it with the earlier self appraisal system.
2. Adhoc teachers: Adhocism in the university departments and colleges is on the uncontrolled rise. University has done little to end this menace. In every college and university department there is huge number of adhoc teachers. Yet university and colleges are not holding interviews for filling up the vacancies. This must start immediately and a deadline be set for all colleges and university to complete the filing of all posts on permanent basis within the next 6 months. There is a need to have a relook at the policy framed by university for the appointment of adhoc teachers. Adhoc teachers are being exploited and the administrators find it expedient to keep them adhoc for as long as possible, at times for a decade.
3. Medical Scheme: A comprehensive medical scheme is needed for university employees with an approved list of all major list of hospitals, clinics and diagnostic centers with cashless card facility
4. Inter-college Transfers: A policy must be framed to allow the transfer of teachers from one college to another after drawing a common seniority list of various colleges.
5. General Group Insurance: The group insurance needs to be enhanced to a minimum of 25 lakhs in view of the devaluation of money.
6. House Building Advance: As we are all aware the cost of houses and construction have increased many fold in the past few years but surprisingly the government and the university has not enhanced the house building advance which has a ceiling of 7.5 lakhs. Many of our young colleagues are borrowing from the market/banks to build their houses at a higher rate of interest. HBA must be increased to a minimum of 50lakhs at a reasonable rate of interest to provide housing to these young teachers.
7. Infrastructure and Research Grants in Colleges: Lack of infrastructure in terms of proper classrooms, laboratories, tutorial rooms is plaguing the teaching in colleges and departments. Proper and adequate teachers taught ratio is not being adhered to. This apathy of the government and the university administration is degrading the educational standards of Delhi University. There is an urgent need to increase the infrastructure and provide proper facilities for a holistic teaching-learning process. There is a need to create a central research facility both at the North and the South campus for college teachers, in addition to proper research grant and research facilities at the college level.
8. Reserve Teaching Positions: The reserve posts belonging to SC/ST/OBC/PH are not being filled by the colleges and the university. We demand that these posts be filled as per the roster without any further delay.
9. Provident Fund Issue: the 8% cap on the PF interest defies all logic of the statutory PF rules. In many colleges and the university the PF committee does not has the elected subscriber representatives as per the provisions of the PF Act. The university must take the corrective measures in this regard and the earnings be distributed among subscribers equitably.
10. Adhoc Teachers of the Computer Science Department: It is unfortunate that the computer science department of various colleges have denied permanent appointments to many of the deserving colleagues for past many years even though the permanent vacancies existed. It is well known that there is a scarcity of teachers of computer science who are NET qualified. This year many of these teachers have not been allowed to join the colleges on adhoc basis and are forced to work as guest teachers. There is an urgent need for the university and the UGC to exempt these teachers from the NET qualification to safeguard the interest of these teachers and the teaching of the subject.
11. Denial of Contribution to the New Pension Scheme in Delhi Government Maintained Colleges: From the year 2004 the new pension scheme was introduced by the central government. This scheme in itself has many flaws and is equivalent to denial of pension to the teachers appointed after 1st January 2004. After the pay revision now the Delhi government has come into the denial of their part of contribution to this scheme.
12. Full academic status to librarians: it is unfortunate that in spite of all logic and reasons the librarians of the colleges are not accorded with full academic status equivalent to teachers. This should be done by the university without any further delay and librarians are accorded full academic status equivalent to teachers. The university should introduce an application course in the library science at the UG level (BA program). The age of superannuation of the librarians should be immediately raised to 65 years.
13. CPF to GPF: in accordance with the May 1987 GOI notification those teachers who did not opt to remain in the CPF scheme till September 1987 should be automatically considered to be in the GPF cum Pension scheme. This is in keeping with the Supreme Court judgment in a similar case. For the remaining, university should evolve a separate scheme for providing pensions.
14. Physical Education Department: there is an urgent need to start a physical education department at the university level. This will provide an opportunity to our physical education teachers to achieve their further academic goals. Unfortunately the university sports council has also been made defunct. The central sports facility of the university also remains non-utilized for the university sports and activities. The university physical education department can take care of growth and maintenance of physical education as subject as well as the sports activities of the university.

NDTF Stands For A United Struggle

State of the University

When teachers vote on 25th August, 2011 for electing the DUTA leadership for the next two years, it will be desirable that they ponder over the state of our Delhi University, and its colleges, today. There is an utter unmitigated chaos prevailing at all levels of administration, all democratic norms of lawful decision making are being ignored without any resistance, academic norms are being violated in the name of hurried implementation of the semester system, the university statute book (its statutes ordinances and regulations) have lost all meaning and the decisions are being dictated from above, students and teachers are confused on the contents of the illogically assembled semester based courses of study (in certain cases there are multiple drafts of the syllabus circulating will no one to

clarify as to which one is the correct draft), 54% OBC expansion has taken place without appropriate addition to the infrastructure resulting into space crunch in the classrooms and laboratories, admission norms-dictated from the ministerial and university authorities are darkening the future of thousands of deserving students, even though the new pay package is effective form 01-01-06 the administration has failed to frame ordinances relating to promotions and placements, there is an anomalies galore prevailing on the issues of

‘pay, placement and promotion’, the points gathering system under the quantified PBAS & API regime is making all young teachers apprehensive about their future prospects, uncertainties and confusions are staring into the collective face of ad hoc teachers.....

Desired DUTA Leadership

In such a situation it is imperative that we have a DUTA leadership which is capable of rising above narrow partisan considerations for uniting all sections of teachers (after all there is only one DUTA). Also the vision of the DUTA leadership should be geared towards inclusive and comprehensive development. The leadership should be capable of simultaneously pursuing all issues: pay scales and promotions; service conditions; provision of academic and research facilities; preservation and strengthening of democratic norms and the university statutes, ordinances, etc in the decision making processes; reestablishing

the prestige of the University Court, the Executive Council and the Academic Council; provision of appropriate infrastructure (classrooms, laboratories tutorial rooms, departmental / individual rooms for academic/research work, internet/research/books/journals allowance) to all teachers; rationalization of admission processes, etc.

HRDM’s Offensive

Friend, we have noticed that the Central Government, more particularly the H R D Ministry and the Minister Kapil Sibal, has launched a sustained offensive against the university system. After irreversibly mauling the edifice of the school education system, the HRD Ministry is now aiming its destructive attention on our university systems, With bills like ‘Foreign Educational Institutions Bill’, ‘Educational Tribunal Bill’ & ‘National Accreditation Regulatory Authority Bill’ the autonomy of the university would vanish totally. Market forces shall rule the academic processes in higher education domain. The forced implementations

of the semester system, despite its glaring defects, is the trailer of the future scenario.

DUTA’s Duty

It is the duty of the collective body of teachers to honestly and persistently oppose the offensive jointly launched by the UPA Government, the HRDM and the university team. The beginning of such a united struggle was reflected in the initial few months of the ‘semester’ struggle. But after the November 2010 order of the Delhi High Court on semester related PIL, both the unity and the struggle completely collapsed. The AAD/Congress leadership of the DUTA abandoned all will to fight on the semester issue except through legal presentations in the court. The DTF-Left broke the united struggle by floating JAB which intervened in the Delhi High Court and the Supreme Court with disastrous results. The collapse of the semester struggle has emboldened the university and the MHRD authorities to ride roughshod over all decision making processes in the university. The

manner in which the incumbent VC has implemented the semester courses in all the faculties and departments at the UG level has surpassed the authoritarianism even of the outgoing VC, Deepak Pental. The HRD Minister and the UPA Government are obviously behind all these moves to destroy the autonomy of our university system. The trouble is that the AAD-Congress leadership of the DUTA has now completely surrendered to the Vice Chancellor Proof, Dinesh Singh and is functioning ‘at his pleasure’. The DTF leadership is in collusion with many factions of INTEC-Congress (for electoral and other gains) and indulges only in theatrical and rhetorical militancy. One or two examples would prove

that both groups are hand in gloves with the university and governmental authorities. Both AAD and DTF have one elected teacher member teach in the D.U. Executive Council. Yet neither of them lodged any formal protest when the E.C. raised the WUS membership fee to Rs. 500 per month and renewal (for retiring/retired teachers) fee to whooping Rs.60,000. And that too retrospectively!! Again when the concept of ‘contractual’ teachers to be

appointed against teachers availing of child care leave was mooted by the UGC, no protest was raised. Full time ad hoc / regular leave vacancy appointments should be made against CCL posts. Once the concept of contractual appointments is accepted, this ‘contractual’ malaise will spread in all other domains of appointments. And this is what the MHRD wants!

The need of the hour is to unite and launch a united, protracted struggle against the massive assault launched by MHRD- University team combine. Though we are contesting elections on different platforms, but we should remember that there is only one DUTA and that once the elections are over all of us have to struggle together under a common banner. The DTF claims that they are the monopoly holders on all forms of struggles. History has proven them wrong. The AAD claims that their proximity to the government and the university bosses will bring the desired results. Nothing could be more wrong and ridiculous. What

would yield result is one constant and united struggle. The NDTF assures you to launch such a struggle.

SOME ISSUES

No group has any exclusive issues, all groups have common issues. The NDTF will pursue all the issues, all the demands, accepted by the General Body of the DUTA. Of course the issues have to be prioritized but all issues have to be pursued.

Ordinances on Promotions / Placements, etc. : The thrust of the PBAS-API scheme, sought to be enforced by the UGC-MHRD, is to deny rather than grant promotions. The University AC-EC should frame ordinances so as to eliminate the negative rigor of the PBAS-API scheme. The self appraisal system should replace the points system.

Removal of Anomalies The new pay package has created a huge number of anomalies. Some seniors are forced into a lesser point Vis a Vis some their juniors. Some professors have been placed at lesser pay point compared to their colleagues. All professors must be placed at Rs.43, 000 (min.) w.e.f. 1.1.2006. Similarly all senior lecturers, whether promoted before or after 1.1.2006, should be placed at Rs.18, 600 + Rs. 7000 AGP. Appointments of assistant professors directly at the AGP of Rs.7000 / 8000 have downgraded some of the senior Asstt. Professors in term of AGP. This must be rectified.

No Quota System at any stage of promotion to Professorship.

CPF to GPF. Those teachers who did not opt to remain in the CPF before 30-09-1987 should be deemed to be in the GPF scheme (in consonance with the GOI order on CPF/GPF of 1st May 1987). Others must be allowed to switch over from the CPF to the GPF scheme.

Parity of Librarians: with teachers in all respects. This issue should be settled by the University EC & AC all times to come.

Ad hoc teachers: exploitations and uncertainties faced by ad hoc teachers should end. 54% increase under the OBC expansion has created more posts but the authorities are not filling them. Besides, the implementation of the semester courses, coupled with rumors of ban on regular appointments for the next 3 years have made ad hoc teachers very nervous and vulnerable. All posts should be filled appropriately during the next 6 months.

Cap on PF Interest: The 8% cap on the interest on PF enforced by the university on its employees & teachers, and some of its colleges, must be scrapped. The principle of distributing the entire interest earned, with minor adjustments, to the subscribers must be strictly adhered to.

Improvements in the Health Care Medical Schemes and Housing facilities.

Uniform upward revision of for taking guest lecturers at the SOL, NCWB, Colleges without differentiation.

Some principals of colleges (viz. RLA, Dayal Singh, and Kalindi) are on path of destroying their institutions. They play tricks to deny the rights to teachers and deviate the focus from teaching-learning process. The university should take appropriate actions against such principals.

There is an urgent need for providing the desired infrastructure and facilities for differently-abled teachers & students.

The long standing demand of science teachers from colleges for providing them with research facilities and allowing them to guide Ph.D student must be addressed immediately.

In some colleges like A.N.D. and Dyal Singh, ad hoc teachers are forced to sign the attendance register. This must stop immediately.
